BENADOR: THE FUTILITY OF TRUMP IMMIGRATION EOs

Three Trump immigration executive orders, with the last one on sanctuary cities, have now being halted by three unknown district judges.

Because the Administration cannot force “sanctuary cities” as the Big Apple to cooperate with immigration officers by withholding federal funds, California US District Judge William Orrick has issued a temporary ruling arguing that Trump had no authority to attach new conditions to federal spending.

His ruling resulted from a lawsuit filed by San Francisco and Santa Clara County against the executive order.

Needless to say, Judge Orrick is an Obama appointee.

The plaintiffs argued during an April 14 hearing that it threatened billions of dollars in federal funding for each of them, making it difficult to plan their budgets.

Federal law doesn’t define “sanctuary cities,” and the Trump administration had given differing descriptions of the policies it was looking to enforce.

More than 300 cities and counties nationwide have placed limits on how far their law enforcement agencies are allowed to cooperate with federal immigration officials looking to detain and deport immigrants for crimes or illegal entry to the US.

“The Counties have demonstrated that they are likely to succeed on the merits of their … challenge to the Executive Order, that they will suffer irreparable harm absent an injunction, and that the balance of harms and public interest weigh in their favor,” Orrick wrote.

Below the write-up showing that it’s Congress, not the President,  who has authority to attach new conditions to federal spending.

“The Constitution vests the spending powers in Congress, not the President, so the Order cannot constitutionally place new conditions on federal funds. Further, the Tenth Amendment requires that conditions on federal funds be unambiguous and timely made; that they bear some relation to the funds at issue; and that the total financial incentive not be coercive. Federal funding that bears no meaningful relationship to immigration enforcement cannot be threatened merely because a jurisdiction chooses an immigration enforcement strategy of which the President disapproves.”
So, if the DOJ believes that the scope of the Executive Order would only impact $1mm in federal funding and was “merely an exercise of Trump’s ‘bully pulpit’, then we have to wonder whether the whole thing was just a charade to avoid more “flip-flopping” accusations?  What say you?

So, the Attorney General and Trump’s legal staff could not have warned the President there was a weakness in his executive order?

What comes next?

 By now, the Trump Administration is familiar with the next step.

 They will have to appeal Orrick’s ruling to the Ninth Circuit Court of Appeals.

A three-judge panel blocked Trump from enforcing the first iteration of his controversial travel ban in February, and the entire court will weigh the constitutionality of the second version on May 15.

So President Trump is powerless in front of those Obama judges?  

And, how so?   The American electorate and the electors of the Electoral College gave him the Presidency.  The people gave him the Senate.  And the House.

Three executive orders have been aborted.  All on the same topic:  illegal immigration.  Coincidence or plot?

Trump recently ordered the targeted bombing of a Syria military base on assumptions with no tangible proof.  In doing so, America sided with the ISIS terrorists.

Then Trump gave his blessing for a MOAB, the most powerful non-nuclear bomb to bomb a place in Afghanistan.  This time the attack was destined against an unknown ISIS faction.

With so many serious decisions he has already made, how come the President does not impose his will on Speaker Ryan to gather all the strength of the House, the Senate in support of the President?

If Trump was as concerned about the fate and well-being of the American people, as he repeatedly said during his rallies, how can so easily drop the towel each time a miserable judge places an injunction on his executive orders?

Why doesn’t Trump make rallies about this?  

The people would listen and would make their voices be heard loud and clear to support their President.   What is Trump waiting for?

For, executive orders, are just plain paper with a signature.  It’s about the implementation of the orders contained in those papers that counts.

How about firing all those judges, if need be, Congress should impeach all of them.

The President must do whatever is necessary to stop the travesty.

Conclusion

The President slow abdication of his initially promised nationalist agenda in favor of a vastly globalist entourage, makes one wonder if all this was not part of a well-choreographed trap to lure voters.

We hope we are wrong and will gladly apologize for assuming such.   If proven wrong.

Remember, Trump is a fighter and how frantically he worked to be elected, all the effort he and his family, especially his daughter made for him to be elected.

Who can forget:  “My father will never let you down,”    Right.

If that is so, America needs her President, to stand up to Paul Ryan, demand his allegiance to the cause of America or demand his immediate resignation.

America needs the full and undivided Presidential attention and devotion to the cause of the people.

This author is not against Trump, on the contrary, but time is of the essence and unless the people show their concern, the President will not know the seriousness of the situation.

The billionaire and his billionaire family have surrounded themselves with billionaires.

What do they know of the plight of the rest of Americans empty pockets, of the struggle to get food on the tables to feed your families, of the sick Americans, of the heroic 22 vets who can’t stand life anymore and commit suicide on a daily basis, and all those millions who are suffering for so many reasons?  What do they know?

There should be NO compromise when the safety, well-being, and prosperity of Americans are at stake.

President Trump must do the job that he is being paid for.  Another campaign promise was broken:  “I won’t receive a salary.”   But he did.  Nothing wrong with receiving a salary for a job done.  Now we need that job to be done to perfection and fulfill all campaign promises.

Executive orders are useful when implemented for if not implemented they are proof of failure.

It is imperative to stop illegal immigration, send back illegals, build the wall, cut taxes, as promised.
The President must make sure sanctuary cities cease to exist, they are the crib of foreign lawlessness in America, jeopardizing the safety of American citizens.

 

America cannot wait.

  1. There is one issue you did not address, and I agree with you on most of what you said, PRES. Trump must force Paul Ryan to support his agenda, but the issue I’m speaking of is a Civil War in the USA because “we the people “the majority, are COMMON people FED-UP with our government and our US Constitution gives us the authority to change it when it will not change itself, to bow to the will of the people ! Many militias are being formed as we speak we have terrorist training camps run by Islamic Muslims in several states in the USA ! This country truly is in DEEP SHIT! PLEASE continue writing your column wish you could get to a bigger audience !
